Deed of Purchase and Sale
The Deed is a formal contract of Purchase and Sale and is signed in a Notary's office. The contract is drafted by the Notary, and the parties or their lawyers with Power of Attorney must be present.
Before the Deed, the tax on real estate transactions (IMT) must be paid, and the receipt of payment must be handed to the Notary.
The Notary will very the location of the property, and will require the certificate from the Land Registry Office, Certificate from the Tax Department, and Habitation or a certificate from the city council of the area saying that the building was built before 1951 when a habitation licence was not required.
From the moment the Deed is signed, the property belongs to the new owner.
